What follows is the correspondence between Justice Brian Walker and Rob Hurlburt and then Rebecca Forest of Women On The Wall.  The first message included a cc to Dave Welch, Founder and President of the US Pastor Council, and Walker's Pastor.

My name is Rob Hurlburt and I am a close friend of John and Nubia Devine and their family. I work in several fields in both business and ministry, but for the past year have focused on several pro-life activism projects. I am licensed (North Richland Hills Baptist Church - now Cross Church FW) and ordained (Riverbend) Southern Baptist, but I am a member of Hill Country Bible Church and attend the Steiner Ranch campus in Austin. I am very active in the Men’s Ministry.

I read on your bio that you list first your commitment to Christ. I read that you have preached at your church, and even received a degree from Dallas Theological Seminary — an outstanding Seminary!

I entreat you to watch two excerpts (here, and here) from an upcoming short documentary I am producing called “Elizabeth’s Story.” It tells the story of John and Nubia‘s seventh child, Elizabeth, who was diagnosed with Trisomy 13, a horrific chromosomal birth defect. The story focuses on the decisions John and Nubia made, including Nubia‘s decision to carry Elizabeth to term, despite a very real risk to her life. Nubia is the main focus of the story and she is the centerpiece of a much larger project called Extremists For Life. She is one of the Godliest persons I’ve ever met, and we’ve been friends for over 20 years.

Unfortunately, your hit-piece attack video (“Devine Injustice” with Dolcefino and Hartmann) suggests Nubia is, in fact, a criminal who stole furs and jewelry from Elvie Kingston. Nubia is Elvie’s court-appointed guardian, as you know, and she was “awarded possession” of those items to provide safe-keeping of them, which she has done. Several friends of Elvie have produced the website TheTruthAboutElvie.org to refute your claims.

I was brought on the Devine campaign to help with the general election as we are pivoting toward the Democrats with their barrage of attacks on John for his Pro-Life positions. However, I am having a difficult time making this pivot because a significant number of Republicans still believe your video. I was devastated to hear reports from the RPT convention that some of the women were calling Nubia a “gold-digger” because of it.

I believe you owe the Devines and the Republican Party of Texas a public apology. You have caused significant damage to their reputation and to this campaign and to our effort to keep the insidious Democrats from gaining a foothold in our Texas state government.

After reviewing my friend Rob Hurlburt’s email to you and your dismissive response, it begs the question: “Have YOU read the Harris County court file in the Elvie Kingston guardianship matter?” I certainly have, as I am the researcher for TheTruthAboutElvie.Org (“TTAE”) project – assisted by Friends of Elvie. Since you asked Rob not to contact you again, you are getting me instead.


My name is Rebecca Forest, you can learn more about me HERE. I am also a friend of the Devine family, although I am not part of John’s re-election campaign. I also know Elvie from attending John’s campaign events in her home.  TTAE was created specifically to counter all of the lies you pushed out about John and Nubia in your attack video “Devine Injustice." TEC records show that you paid Wayne Dolcefino $10,741.26 to produce that video with content that lacks any evidence, is purposefully misleading and blatantly untrue. The most egregious parts have to do with Nubia Devine. It is noteworthy that you felt you could attack the WIFE of your fellow Republican opponent in such an unethical manner. In Texas at least, that is still considered out of bounds.


It is telling that in your video that you allowed Elvie’s niece Michelle Hartman to insinuate that Nubia somehow nefariously acquired Elvie’s furs and jewelry for her personal use. Given your position, that is unacceptable since you certainly understand the language of the actual Decree pertaining to the furs and also the Decree pertaining to the jewelry, entered by the Court. Clearly both Decrees provided for the “distribution” of Elvie’s jewelry (which was unsalable) and her six (6) furs (which had been set aside per Elvie’s wishes) to Nubia as the Court-appointed Guardian of the Person of Elvie Kingston, on behalf of and for Elvie’s use and possession. They were not “awarded” to Nubia for her use (as your video alluded to) and you know that. Upon delivery of those items to John and Nubia’s home (Elvie’s home) the belongings were placed in Elvie’s room for her to wear and enjoy at any time.


If you reviewed the documents of record in this matter you would have immediately seen the “Application for Appointment of Temporary Guardian of Person and Temporary Guardian of Estate” (3/15/22), and the “Amended Application for Appointment of Permanent Guardian of the Person and Appointment of Permanent Guardian of the Estate” ( 6/10/22). Both of those 82 /84 page documents contain vast amounts of information concerning Elvie’s family members, her health, her financial situation, and three (3) very detailed sworn Affidavits given by Elvie’s long-time friends two (2) of whom answered her pleas for help twice! They rescued her from two (2) sub-standard facilities out of the five to seven (5-7) her niece confined her to in an approximate four (4) month period.

Michelle stated in one text that Elvie had exhibited some “behavioral issues” – not surprising given the facts. If Michelle were as close to Elvie as she would have us believe, she would have known how Elvie would react to the trauma of being moved so many times to unfamiliar surroundings. Elvie was cognizant enough at that time to know that she had lost her freedom, and that Michelle had taken her freedom from her. She was not happy about that, nor should she have been – given her resources and her behavior understandably reflected that.

Elvie owned and lived in an expansive, beautiful home when she was uprooted and confined by her niece. She had the financial resources to afford a high level of personal care from excellent caregivers in a beautiful home with just one person to care for. Alternatively, there are highly rated care facilities that Michelle could have placed Elvie in – why didn’t she? She instead chose to move her Aunt around to many care facilities (some of which we know were rated sub-standard) and also psychiatric facilities.


Given all the above, it is very hard to understand how you came to the conclusion that it was a clever idea to be part of the false narrative of an obviously disgruntled beneficiary who I assume shared limited information with you.  From a review of the record and discussions with knowledgeable friends, it appears more effort was made on Michelle’s part to preserve Elvie’s assets for the benefit of the beneficiaries rather than for the welfare of Elvie during her lifetime.

You made outrageous insinuations about John’s comments during the “got ya’ interview” with Dolcefino as John attempted to share photos of Elvie confined in deplorable, unsafe conditions telling Dolcefino, “They’re trying to kill her.”  You had the audacity to insinuate that John was suggesting that anyone who placed a loved one in a care facility was trying to kill them! John has never said anything of the sort. There are very legitimate reasons why he made that statement about Elvie’s confinement, but you did not bother to inquire why.


Your ”What are you doing with the finances, what are you doing with the monies?” statement falsely implies that John is a thief who would recklessly disregard Elvie’s needs and well-being while performing his Court-appointed duties. When, in truth, there is significant oversight over the expenditures that are made. The Trust attorneys answer any questions the Trustee might have concerning expenditures, and they also review the details of the expenditures to prepare the reports which are required by the Court. In addition, the Court-appointed attorneys for both Elvie and for her Estate receive those required reports.

 

The whisper campaign surrounding your video was effective in making thousands of Republicans voters doubt and misjudge John (and Nubia). It almost worked in the Primary! If only the claims you presented were true – they were not!

 

Those same voters might still believe the lies. While they may not actually vote for John’s Democrat opponent in the General Election, they may simply choose not to vote for John. That is a very real possibility with dire consequences given the elimination of straight party voting in Texas. Your poor judgment has caused damage to John and Nubia’s reputations, to his campaign moving forward to the General, and to the Republican Party’s efforts to keep the insidious Democrats from gaining an extremely important seat on the Texas Supreme Court and getting closer to their goal of “Turning Texas Blue.”


I (and many others) believe you should issue a public apology to John and Nubia, remove your video (that is still online), and publicly endorse John. That is the only way to begin to rectify the damage you have done to them personally, and to the Party. The question is, are you courageous enough to admit that you made a mistake? I pray that you are, as there are many who will not be pleased by your actions when they learn The Truth About Elvie.
